Obama: Deal is 'within sight,' not yet complete

Updated at 4:50 p.m. ??The United States was set to go over the "fiscal cliff" at midnight after House Republicans said a series of unrelated votes this evening would be their last for the day.

In the final hours before tax increases and spending cuts take effect on Jan. 1, 2013, President Obama delivers an address from the White House stating that a deal could be near but much work remains to be done.

As of late afternoon on New Year's Eve, negotiators had not yet reached a comprehensive deal to avert the combination of automatic tax hikes and spending cuts that will take effect on Jan. 1. But unless House Republicans decide to add additional votes to the schedule ? an option GOP aides said they had not ruled out ? the government was all but certain to go over the cliff, triggering automatic tax increases for all Americans and deep cuts in military and discretionary spending.

As the hours dwindled before the midnight deadline, talks between Senate Republicans and the Obama administration had failed to produce an accord. Senate Minority Leader Mitch McConnell, R-Ky., said mid-afternoon that both sides were "very, very close" to an agreement and had, in fact, made a deal allowing taxes to rise on individual income over $400,000 per year, and household income of $450,000 per year.

The sticking point involved the "sequester," the automatic and swift cuts to spending that make up the second prong of the fiscal cliff. Republicans have signaled they might let the sequester take effect unless it was offset by other spending cuts; the GOP has also said it might accept a delay, but only for a few months.

Sen. Mitchell McConnell, R-Ky., says he is "happy to report" that both sides of the fiscal cliff debate have reached an agreement on "all of the tax issues" and recommends passing the tax-relief portion of the compromise now, while congress continues to negotiate spending cuts.

The Obama administration, however, is pushing for a longer delay in implementing the sequester. Otherwise, the president said, replacing those automatic cuts must be "balanced" ? shorthand for a combination of new taxes and other spending cuts.

President Barack Obama tried to push talks over the finish line earlier in the afternoon with a statement from the White House.

"Today, it appears that an agreement to prevent this New Year's tax hike is within sight," the president said at the White House. "But it's not done."

In the absence of a broader agreement to resolve the sequester, McConnell appeared in the Senate floor to request a vote only on the tax element of the fiscal cliff.

"Let's pass the tax relief portion now," he said. "Let's take what's been agreed to and keep moving."

But it's not clear that Democrats, who were led in negotiations by Vice President Joe Biden, would agree to de-link the tax debate from other fights over the sequester and extending expiring unemployment benefits past Dec. 31.

House Republicans were careful to note that it was still possible for them to add votes late on New Year's Eve. But they also argued that there was no Senate-passed legislation on which they could schedule a vote, making the prospect of avoiding the cliff all the less likely.

Democratic and Republican sources in the House told NBC News that a final vote on any deal would now most likely wait until afternoon on New Year's Day, or even on Jan. 2.

Though Congress could still conceivably act after New Year's to preserve existing tax rates ? thereby limiting any lasting effect on consumers ? their inability to reach an agreement until the very last minute could still threaten to rattle the economy and markets.

The House did act late Sunday, though, to clear the way for emergency consideration of Senate legislation if leaders are able to reach an agreement. The House Rules Committee convened with the purpose of dispensing with a rule instilled by Republicans in the early days of 2011 to require that legislation be posted online for a full 72 hours before a vote in the House. GOP leaders had sought that rule to showcase their own transparency, and in reaction to actions by the previous Democratic majority to quickly pass legislation during the health care reform battles of 2010.

Republicans' move to sidestep their own rule underscores the urgency of fiscal cliff talks in the final hours of 2012. There were few ironclad assurances, though, that any Senate agreement would necessarily win the support of the House.

The lurching nature of legislating has been characteristic of the Congress during the last two years, and that's a phenomenon that may well continue into the next Congress, when Democrats will continue to retain control of the Senate, and Republicans will hold a slightly slimmer grasp on the House.

US backs Argentina in debt restructuring case

AFP - The US gave strong support to Argentina on Friday in the Latin American country's legal battle with hedge funds over the repayment of $1.3 billion to holders of defaulted bonds.

Shortly before a court-imposed deadline, the US filed a "friend of the court" brief backing Argentina's attempt to overturn a ruling ordering it to make good on the bonds held by US hedge funds.

A hearing for Argentina's appeal has been set for February 27, 2013, again putting off a reckoning over Argentina's debt, which fell into arrears 11 years ago.

In a 15-page document, the administration of President Barack Obama warned the court that the November ruling "adopts a novel interpretation of a standard pari passu (fairness) clause" that "runs counter to longstanding US efforts to promote orderly restructuring of sovereign debt."

The US also warned the ruling could create risks for the dominance of the dollar in the bond market.

"The decision could encourage issuers to issue debt in non-US currencies in order to avoid the US payments system, causing a detrimental effect on the systemic role of the US dollar," it said.

Argentina defaulted on some $100 billion in debt in 2001, and has since restructured its debt twice, covering around 75 percent of the nominal value of the bonds.

But it insists it should not have to repay the $1.3 billion in bonds held by investment funds NML and Aurelius because they refused to take part in a 2005 restructuring agreed to by most of the other bondholders.

The two funds have demanded 100 percent repayment plus interest.

The November 21 ruling by New York lower court judge Thomas Griesa rejected Buenos Aires' position and ordered it to repay the $1.3 billion in full, before or in parallel with any other debt payments the country must make.

With Buenos Aires scheduled to pay out $3 billion on previously restructured debt on December 15, Griesa's order -- if it had been upheld -- would have meant it also must pay the $1.3 billion by that time or fall into default on all of its debt.

The ruling also raised questions for future debt restructurings, such as in Greece.

Beyond worries for the bond market, the US warned in its brief that the ruling could harm US foreign relations, as "such an order could have adverse consequences for the treatment of U.S. property under principles of reciprocity."

Increased Home Building Hints at Recovery in Macomb Township ...

Michigan?s residential building is nowhere near where it was at its 2004 peak, but in Macomb Township and across the state, the signs of recovery are unmistakable.

Home building is picking up in Michigan, with nearly 7,800 permits issued as of September 2012 ? a 32 percent increase over last year, according to the Home Builders Association of Michigan.

In Macomb Township, the number of residential building permits issued increased from six in January to 25 just one month later, in February 2012. This number peaked in March with 48 residential building permits approved for single-family homes and 16 condominium permits.?

?The market was definitely on the up-swing in Macomb Township this year. I believe the increase in home building is a sign of consumer confidence and an attraction to Macomb Township for people to want to live,? said Daniel Fairless, Macomb Township building official.?

The Home Builders Association of Michigan projects that across the state this year, approximately 10,400 new homes will be completed. While this number is up from the 8,001 recorded in 2011, it is only a fraction of the 44,782 homes built in 2004.

This optimism on the part of builders appears to extend across the state, according to a recent statewide survey of homebuilders and remodelers conducted by the HBAM.

Covering the time period of July through September 2012 ? the third quarter ? the survey showed the Michigan Housing Index at its highest level in two-and-a-half years, according to a press release from HBAM.

?The trend lines have been positive, so it is encouraging to see that the outlook for building continues to improve,? said Robert Filka, HBAM CEO, in a press release. ?We?ve got a long way to go before we see anything near normal historical production, but things are definitely headed in the right direction.?

The summer months were also fruitful for Macomb Township, with a total of 49 residential building permits issued in June, 54 in July and in 53 in August.?

Trustee and longtime resident Roger Krzeminski believes Macomb Township?s high numbers are due to many factors, including the township?s five school districts, the many newer commercial developments, and the selection of available homes in varying price ranges, he said.?

?The developments in the various parts of the township and school districts in those areas is what makes this township great,? he said.?

TOKYO (Reuters) - Japan's incoming Prime Minister Shinzo Abe said on Thursday that the Bank of Japan is carrying out policy steps sought by his Liberal Democratic Party (LDP) one at a time.

Abe, speaking at a LDP meeting, said that he received a phone call from BOJ Governor Masaaki Shirakawa earlier in the day informing him of the central bank's monetary policy decision.



The BOJ delivered its third dose of monetary stimulus in four months on Thursday in a prelude to more aggressive action next year, as it faces intensifying pressure from Abe to strive harder to beat deflation.

The Washington Redskins rookie had a full practice Thursday for the second straight day as the team prepares for this week's game against the Philadelphia Eagles.

"I like what I see," coach Mike Shanahan said. "If there is no setback, he should be ready to go."

Griffin missed Sunday's win over the Cleveland Browns with a sprained right knee. On Wednesday, he had his first full practice since the injury, and coaches and doctors were eager to see how the knee would respond.

"There wasn't a setback today, so that's a good sign," Shanahan said.

Also Thursday, right tackle Tyler Polumbus remained unable to practice as he recovers from a concussion. Linebacker London Fletcher (sprained left ankle), linebacker Lorenzo Alexander (right shoulder) and defensive end Stephen Bowen (torn biceps) were limited, and linebacker Rob Jackson returned to practice after the birth of his baby girl.

Alabama communities to receive long-term tornado disaster relief

HACKLEBURG, AL (WAFF)- Governor Robert Bentley will be in Hackleburg Wednesday morning to announce millions of dollars in disaster relief funding.

The funding will be awarded to several communities in both northern and western Alabama as they continue their long-term recovery from the April 27, 2011 tornadoes.

Bentley is expected to make the announcement at 10:30 a.m. at the Hackleburg Fire Department.

The spring tornado outbreak killed more than 250 people statewide on April 27.

Cofounder of Sold.sg, Qiuyan, shares about the e-commerce space in Southeast Asia and the company?s expansion plans.

Sold.sg did a relaunch of their site in September this year, adding in an e-commerce store and a members sales section to the original auctions site. The service, founded by Chiou Hau, Qiuyan and Angeline, started off as a pay-to-bid auctions site. Having raised about S$1 million a year ago, the team is now looking for their Series A funding after the new launch.

Speaking to Qiuyan, e27 finds out more about the expansion strategy of Sold and also what the team has learnt so far about the e-commerce space in Southeast Asia.

Do share more about Sold.sg?s strategy to expand out of the pay-to-bid auction space into a full e-commerce site.

We started out as a pay-to-bid auction site and that gave us significant traffic and user base. However, we noted that pay-to-bid auctions is not for everyone and the natural progression for us is to open up an e-commerce site where we can reach out to a wider base. We will continue to operate our auction model as we have a large group of loyal users that enjoy the thrill and strategy of bidding.

How is Sold.sg?s e-commerce traction versus the auctions?

Most of our revenue still comes from the auction business.?With the e-commerce site, we have significantly expanded our product offerings and this has opened new channels for customer acquisition,?bringing down the overall acquisition costs.?In terms of visits, our most frequented site is still the auction site. Traffic has gone up since we re-launched.

Sold.sg?s e-commerce store puts it in a space with competitors ranging from ?chains stores (Challenger, Courts) to other e-commerce sites (Zalora, Qisahn). How does Sold.sg differentiates itself?

Our product offerings are different. In?Sold.sg, we curate the products we put up ? we only put up products we think are interesting. The e-commerce competitors mentioned?do?not limit their product range if it falls in their verticals.

Are most customers to the e-commerce store converted users of the auction services or are they new customers drawn in by the differentiated offering??

I would say about 60-70% of our shop site?customers?are?not existing auction?users.?This is in line with our?objectives for opening the e-commerce store???to reach a wider audience.

Sold.my has not followed the expansion of Sold.sg yet. Are there plans to the Malaysian side of the business?

Yes, we are looking at 1st quarter of 2013.

What are the key trends in the e-commerce space that the Sold.sg team has noted that presents strong opportunities for the future expansion of the business?

I think without a doubt, there is a growing trend in e-commerce in both Singapore and Malaysia. Singaporeans are generally quite comfortable buying things online. In Malaysia,?online sales and online buyers have nearly doubled over the last two years and this shows that consumers are slowly beginning to have more faith in e-commerce. It also helps that the various online transaction methods available have increased their safety measures, to ensure consumers are more comfortable utilising them.

In some of the other ASEAN countries, based on our research, online buying is low but growing. Trust issues with making payment online and product fulfilment are still prevalent in these countries. However, we are seeing more and more new companies come up with solutions to tackle these issues. This coincides with rising incomes, internet penetration rates, usage of smart devices, and willingness to transact online.?Like Malaysia, we only expect exponential growth in online buying over the next few years. We are definitely looking to expand to these countries and be there to capture this opportunity.

Ala. police kill suspects after separate shootings

BIRMINGHAM, Ala. (AP) ? Police in Alabama fatally shot two suspects Saturday following separate shooting incidents 75 miles apart that left several others, including two officers, wounded.

Authorities said Jason Letts, 38, of Jemison opened fire early Saturday morning at a hospital in Birmingham, wounding a police officer and two employees before being shot and killed by another officer.

Police were sent to St. Vincent's Hospital around 4 a.m. to check on a report of an armed man inside the facility. Two officers who arrived separately converged on the suspect on the hospital's fifth floor.

"When the officer encountered the suspect, there was immediate gunfire from the suspect," Birmingham Police Sgt. Johnny Williams said. He said detectives were still trying to establish a motive.

A handful of cardiac patients and several staff members were on the fifth floor, hospital spokeswoman Liz Moore told reporters during a news conference. She said the hospital is secure and stable, and patient care was not interrupted.

"In light of the recent mass shooting in Connecticut, too many of these incidents end with unimaginable tragedy," Birmingham Police Chief A.C. Roper said in a statement.

In a separate incident, police officers in eastern Alabama shot an assailant armed with an AK-47 assault rifle toward the end of a pursuit that left several people injured, authorities said.

The pursuit began after a shooting in Cleburne County, Oxford police Lt. L.G. Owens told The Anniston Star. The county is near the Georgia state line.

Oxford Police Chief Bill Partridge said a woman and two children were shot, but he did not know their conditions.

Around noon, the chase reached the intersection of Leon Smith Parkway and U.S. 78, a busy retail district. Owens said the suspect fired at law-enforcement officers, injuring a Heflin police officer. Partridge said the suspect used an AK-47 during the firefight.

Officials said the suspect then forced his way into a Nissan at the intersection, although the occupants were able to escape.

Police caught up with the assailant about an hour later in nearby Coldwater. Partridge said two members of the Oxford police SWAT team fatally shot the suspect.

The number of people injured during the spree was not immediately clear. Police officials did not immediately return messages left by The Associated Press.

Law enforcement officials were examining multiple crime scenes Saturday afternoon, trying to determine what happened, said Lynn Hammond, the chief assistant district attorney for Calhoun and Cleburne counties. She said that authorities are investigating a homicide, but she declined to comment further.

Royal prank call: Duped nurse was found hanging

During a hearing in London's Coroner's Court today, details were revealed about the cause of death of nurse Jacintha Saldanha shortly after she took a prank phone call to the Duchess of Cambridge, including that she left three handwritten notes. NBC's Keir Simmons reports.

Updated at 6:20 a.m. ET: LONDON ? The nurse duped by two Australian radio show hosts into putting through a prank call to the hospital ward of the pregnant Duchess of Cambridge was found hanging by a scarf from a wardrobe, an official said Thursday.

Jacintha Saldanha, 46, was found by a colleague and a member of security staff?at King Edward VII?s Hospital in the British capital on Friday, coroner's officer Lynda Martindill told a formal hearing into the circumstances of her death called an inquest.


Police detective chief inspector James Harman told the hearing that the married mother-of-two had injuries to her wrists.?

He also said that three handwritten notes were found, two at the scene and one among her belongings.?

As well as examining the notes, Harman said police were interviewing her friends, family and colleagues and looking at emails and phone calls to establish what led to her death, The Associated Press reported.

Nurse Jacintha Saldanha was found dead days after being hoaxed by an Australian radio show.

At the brief hearing, Coroner Fiona Wilcox opened and then adjourned the inquest until March 26 without making a ruling. Police have previously described the death as "unexplained."

Southern Cross Austereo, the station?s parent company, has apologized for the stunt and said on Tuesday it would donate its advertising revenue until the end of the year to a fund for Saldanha's family, with a minimum contribution of about $525,000.

New-found tale could be Hans Christian Andersen's

COPENHAGEN, Denmark (AP) -- For years, the somber fairy tale about a lonely candle who wanted to be lit dwelt in oblivion at the bottom of a box in Denmark's National Archives. Its recent discovery has sent ripples through the literary world because it is believed to be one of the first tales ever written by Hans Christian Andersen.

The famed Dane wrote nearly 160 fairy tales in his life, including classics such as "The Ugly Duckling" and "The Little Mermaid." The tale of the candle may have been written when he was still a teen, experts say.

Retired historian Esben Brage said Thursday that he found the six-page text on Oct. 4 while searching through archive boxes that had belonged to wealthy families from Andersen's hometown of Odense in central Denmark.

The handwritten copy of the tale, entitled "Tallow Candle," and dedicated to a vicar's widow named Bunkeflod who had lived across from Andersen's home, had been left seemingly untouched at the bottom of one of the boxes.

"I was ecstatic," Brage said. "I had never imagined this."

The short story tells the tale of how a tallow candle seeks help from a tinder box to be able to ignite itself. A senior curator at the Hans Christian Andersen Museum in Odense said the work is likely one of the author's earliest, written at the age of 18 ? seven years before his official debut in 1830.

"I often get calls about stuff thought to have been of Andersen's hand. Most of the time, it is not. This time I was thrilled," Ejnar Stig Askgaard told The Associated Press. "This is a very early attempt at prose by Andersen, who was then 18."

Askgaard said Andersen regularly visited the Bunkeflod widow, reading to her and borrowing books from her, even after he moved to Copenhagen to attend university.

"The text is not at the level of the more mature fairy tales that we know from Andersen's later writing," Askgaard said. But "we see traces of Andersen's history in the text, the language and the themes in the manuscript ... it all fits with him, it all bears his fingerprint."

The Danish language "Doedningen" from 1830 had long been considered Andersen's first fairy tale. That story was later re-written and published again in 1835 as "The Traveling Companion" ? a grim tale about death.

Andersen was born in 1805 in Odense, 105 miles (170 kilometers) west of Copenhagen, to a cleaning lady and a shoemaker. While famed for his many fairy tales, he also wrote dozens of novels, poems and travel journals. His works have been widely translated. He died in 1875.

U.S. drops China's Taobao website from "notorious" list

WASHINGTON (Reuters) - The United States on Thursday dropped a website owned by China's largest e-commerce company, Alibaba Group, from its annual list of the world's most "notorious markets" for sales of pirated and counterfeit goods.

Taobao Marketplace, an online shopping site similar to eBay and Amazon that brings together buyers and sellers, "has been removed from the 2012 List because it has undertaken notable efforts over the past year to work with rightholders directly or through their industry associations to clean up its site," the U.S. Trade Representative's office said in the report.

The move came just before an annual high-level U.S.-China trade meeting next week in Washington.

Taobao Marketplace is China's largest consumer-oriented e-commerce platform, with estimated market share of more than 70 percent. The website has nearly 500 million registered users, with more than 800 million product listings at any given time. Most of the users are in China, Hong Kong, Taiwan and Macao.

The U.S. Chamber of Commerce has called Taobao "one of the single largest online sources of counterfeits."

The Chinese Commerce Ministry strongly objected to Taobao's inclusion on the USTR's 2011 notorious markets list. A ministry spokesman said it did not appear to be based on any "conclusive evidence or detailed analysis.

Alibaba hired former USTR General Counsel James Mendenhall to help persuade USTR to remove Taobao from its list.

The Chinese company's bid to shed its "notorious" label won support from the Motion Picture Association of America, a former critic of Taobao, which praised its effort to reduce the availability of counterfeit goods on its website.

But U.S. software, clothing and shoe manufacturers urged USTR to keep Taobao on the list.

To stay off in the future, USTR urged "Taobao to further streamline procedures ... for taking down listings of counterfeit and pirated goods and to continue its efforts to work with and achieve a satisfactory outcome with U.S. rights holders and industry associations."

USTR said it also removed Chinese website Sogou from the notorious markets list, based on reports that it has made "notable efforts to work with rights holders to address the availability of infringing content on its site."

U.S. concerns about widespread piracy and counterfeiting of American goods in China are expected to be high on the agenda at next week's meeting in Washington of the U.S.-China Joint Commission on Commerce and Trade.

The 2012 notorious markets list includes Xunlei, which USTR described as a Chinese-based site that facilitates the downloading and distribution of pirated movies.

Baixe de Tudo, a website hosted in Sweden but targeted at the Brazilian market, was also put on the list along with the Chinese website Gougou.

Warez-bb, which USTR described as a hub for pre-release music, software and video games, was also included. The forum site is registered in Sweden but hosted by a Russian Internet service provider, USTR said.

Hot flushes affect millions of people, and not just women. Yet, it is still unclear what causes the episodes of temperature discomfort, often accompanied by profuse sweating.

Now a team of researchers around Dr. Naomi Rance, a professor in the department of pathology at the UA College of Medicine, has come closer to understanding the mechanism of hot flushes, a necessary step for potential treatment options down the road. This research was published recently in the Proceedings of the National Academy of Sciences.

The team identified a group of brain cells known as KNDy neurons as a likely control switch of hot flushes. KNDy neurons (pronounced "candy") are located in the hypothalamus, a portion of the brain controlling vital functions that also serves as the switchboard between the central nervous system and hormone signals.

"Although the KNDy neurons are a very small population of cells, our research reveals that they play extremely important roles in how the body controls its energy resources, reproduction and temperature," said Melinda Mittelman-Smith, who led the study as part of her doctoral thesis. "They are true multitaskers."

By studying KNDy neurons in rats, the research team created an animal model of menopause to elucidate the biological mechanisms of temperature control in response to withdrawal of the hormone estrogen, the main trigger of the changes that go along with menopause.

They discovered that tail skin temperature was consistently lower in rats whose KNDy neurons were inactivated, suggesting the neurons control a process known as vasodilation, or widening of the blood vessels to increase blood flow through the skin.

"The hallmark of hot flushes is vasodilation," explained Rance, who also is a neuropathologist at The University of Arizona Medical Center. "When you flush, your skin gets hot and you can see the redness of the skin. It is an attempt of the body to get rid of heat, just like sweating. Except that if you were to measure core temperature at that point, you would find it is not even elevated."

Although the results are not yet directly applicable in helping individuals affected by hot flushes, they mark a necessary first step, Rance said.

"Obviously we can't do these studies in women, and only if we understand the mechanism is there a chance of developing therapies. All that is known so far is that dwindling estrogen levels have something to do with it but anything after that is a black box."

"Right now the only effective way of treating flushes is estrogen-replacement therapy. If we could figure out what is causing those flushes, we could try to develop a better, more targeted therapy."

Rance said hot flushes usually last for four or five years and occur in up to 80 percent of women but also in men undergoing certain hormone treatments for prostate cancer.

"For some people it's not too bad, but it can be very severe in other individuals; they loose sleep et cetera. So the question I have been asking myself is, 'How come we haven't figured this out?'"

Together with her coworkers, Rance has studied KNDy neurons and their functions for two decades.

"KNDy neurons respond to circulating estrogens," Mittelman-Smith explained. "When these hormones are at very low levels, as is the case in menopause, these neurons go haywire if you will. They grow very large and manufacture several times more neurotransmitter than they did with estrogens present."

"Because the neurons talk to known thermoregulatory centers of the brain, we think this increased signaling activity may inappropriately tell the body, 'I'm hot, release heat.' This triggers heat loss mechanisms like sweating and opening up of blood vessels in the skin."

Analogous to women going through menopause, the tail skin temperature goes up in rats after removal of the ovaries, where estrogen is produced.

"Rats regulate heat dissipation with their tail because the rest is covered by fur," Rance explained. "In rats without ovaries, the lack of estrogen causes vasodilation, which we can measure as increased tail skin temperature."

"Once we knew that estrogen really does control tail skin temperature in a rat, we wanted to know what role, if any, the KNDy neurons play in this."

When Rance and her team compared the tail skin temperatures of rats with intact KNDy neurons to those with inactivated KNDy neurons, they discovered that while tail skin temperatures still followed the same ups and downs over the course of the day and night cycle, they were lower in the absence of KNDy activity.

"They have lower levels of vasodilation," Rance said. "It is very consistent. Their tail skin temperature is lower than rats with normal KNDy neurons and stays low. It doesn't matter if they have estrogen or not; it doesn't matter if it's night or if it's day."

"The rats didn't seem unhappy at all," she added. "You'd think they'd be curling up and shivering, but no. There was no difference in the core temperature, so they weren't internally cold. We did all the activity measurements and found them to be completely normal. We couldn't tell a difference other than lower vasodilatation."

Rance said she is not surprised that the same neuronal switches that are important for reproduction also control thermoregulation.

"Being able to regulate body temperature is very important for the species and also for reproduction because it is important for a pregnant woman to avoid extreme hyperthermia. Hot flushes are a symptom of hyperactivity of these neurons."

The researchers caution that while KNDy neurons are critical for normal thermoregulation, they are by no means the sole center for managing body temperature.

"These animals would be in much more trouble if that were the case," Mittelman-Smith said. "In fact, I don't view KNDy neurons as a thermoregulatory center at all, but rather a group of cells that has the ability to influence thermoregulatory centers."

Rance added: "I wouldn't say we solved the problem, but we have a good clue about what could be causing the flushes."

US hesitant in condemning North Korean launch

WASHINGTON (AP) ? The Obama administration is drawing no "red line" for North Korea after a successful long-range rocket test, tempering the public condemnation to avoid raising tensions or possibly rewarding the reclusive communist nation with too much time in the global spotlight.

The U.S. has told the world that it won't tolerate Iran's acquisition of nuclear weapons or Syria's use of chemical stockpiles on rebels. North Korea, in some ways, is a trickier case.

The U.S. wants to forcefully condemn what it believes is a "highly provocative act," and that was the first public reaction from the White House late Tuesday. But it also is mindful of the turmoil on the Korean peninsula and treading carefully, offering no threat of military action or unspecified "consequences" associated with other hot spots.

Just two years ago, the North allegedly torpedoed a South Korean warship and shelled a South Korean island. Some 50 South Koreans died in the attacks that brought the peninsula to the brink of war.

North Korea already has the deterrent of a nuclear weapons arsenal. The U.S. is bound to protect next-door South Korea from any attack, but has no desire now for a military conflict.

Raising the rhetoric can even serve as a reward for seeking attention to a government that starves its own citizens while seeking to leverage any military advance it makes into much-needed aid.

"No doubt Pyongyang is pleased. It again has unsettled its leading adversaries. And it is in the news around the world," said Doug Bandow, senior fellow at the Cato Institute. "The allies should have responded with a collective yawn. After all, the plan is nothing new. The DPRK has been testing rockets and missiles for years."

The United States remains technically at war with the notoriously unpredictable North Koreans, whose opaque leadership has confounded successive American administrations. With no peace agreement, only the 1953 armistice ending the Korean War keeps the U.S. and the North from hostilities. Some 28,500 U.S. troops remain in South Korea to deter potential aggression.

Wednesday's surprising, successful launch raises the stakes, taking North Korea one step closer to being capable of lobbing nuclear bombs over the Pacific. As the North refines its technology, its next step may be conducting another nuclear test, experts warn.

The three-stage rocket is similar in design to a model capable of carrying a nuclear-tipped warhead as far as California. The rocket launched a satellite into space. Defense Secretary Leon Panetta said the U.S. would study the launch.

"I think we still have to assess just exactly what happened here," Panetta told CNN in an interview Wednesday. He said part of the assessment would examine the final stage that launched the satellite "to determine, really, whether or not that did work effectively or whether it tumbled into space. I mean, that's the issue that we need to assess."

Despite its technological advances and military bluster, it's doubtful that the North intends to strike first against the U.S.

Even so, Panetta said the U.S. has the capability to prevent such a strike.

"I'm very confident that American defense capabilities are able, no problem, to block a rocket like this one," he told CNN when asked about the capability of U.S. missile defense systems.

North Korea has spent decades threatening but avoiding a direct confrontation with the tens of thousands of American forces in South Korea and Japan. The government has remained firmly in power despite a drought-plagued agricultural sector that leaves many North Koreans in search of food and a crumbling economy that affords few any chance of social betterment.

"It is regrettable that the leadership in Pyongyang chose to take this course in flagrant violation of its international obligations," White House press secretary Jay Carney told reporters. He said the U.S. would try to further isolate North Korea in response.

State Department spokeswoman Victoria Nuland called the launch "highly provocative and a threat to regional security." It will only further impoverish North Koreans, she said.

Neither Carney nor Nuland elaborated on possible consequences. The White House's initial statement referred only to potential action at the U.N. Security Council, which condemned North Korea on Wednesday and said it would urgently consider "an appropriate response." The threat of sanctions is unclear; China, North Korea's benefactor, holds veto power.

Analysts were mixed on whether a tougher reaction was appropriate.

"There has been an unspoken tendency in the United States to discount these tests as yet another foolish attempt by the technologically backward and bizarre country," said Victor Cha, a Korea expert at Georgetown University and former White House policy director for Asia. "This is no longer acceptable. The apparent success of this test makes North Korea one of the only nonallied countries outside of China and the Soviet Union to develop long-range missile technology that could potentially reach the United States."

The administration's restrained response contrasts with the warnings of military action against Iran and Syria for actions far less imminently threatening to the United States, but directly threatening Israel, an important ally.

Obama has said he won't allow Iran to acquire nuclear weapons and insists that he won't get involved in a policy of containment similar to the one the U.S. is stuck with in North Korea. He promises that he isn't bluffing.

The U.S. and Israel have held talks over what benchmarks in uranium enrichment and weapons work the Iranians would have to reach for possible military action to be triggered.

What's clear from his words is that Obama wouldn't wait for Iran to have a bomb, meaning the threshold for a U.S. attack against Tehran is far lower than against North Korea, which tested its first nuclear weapon more than six years ago.

As for Syria, the president has issued a "red line" to President Bashar Assad's government concerning chemical weapons that have never been used and are accompanied by no weapon capable of delivering them anywhere near the United States.

U.S. officials fear the increasingly desperate Assad could deploy the weapons in a bid to win a civil war that has left more than 40,000 people dead since March 2011. Or, he could transfer some weapons to anti-U.S. and anti-Israeli militant groups such as Hezbollah.

Judged on capacity and not intent, either of those scenarios would pale in comparison to the North being able to fire a nuclear warhead at the continental United States. But with U.S. officials convinced that Assad's exit may be nearing, the sterner American cautions in Syria may be less likely to be tested. If they are, the United States wouldn't have to worry about nuclear weapons as a counter-threat.

(AP) ? Prosecutors on Wednesday appealed the dismissal of anti-paparazzi driving charges against a photographer accused of recklessly chasing Justin Bieber on a Los Angeles freeway earlier this year.

The appeal argues that Superior Court Judge Thomas Rubinson erred last month when he dismissed two counts filed under California's 2010 anti-paparazzi law against Paul Raef, a freelance photographer. The judge dismissed the charges on grounds that the 2010 law used to charge him was overly broad and violates the First Amendment.

The judge's ruling could set "a dangerous precedent" that newsgatherers can drive recklessly without facing stiffer penalties, the prosecutors' filing states.

The law raised the penalty for those who drive dangerously in pursuit of photos for commercial gain, but Rubinson said that could be applied to wedding photographers and many other professions.

The offense is punishable by six months in jail and a $2,500 fine but went unused until Raef was involved in the freeway chase of Bieber that topped 80 mph and prompted several 911 calls.

Raef's attorneys, David S. Kestenbaum and Brad Kaiserman had not yet been served with the appeal and could not immediately comment on it.

Rubinson said when ruling on Nov. 14 that lawmakers should have simply raised the penalties for all types of reckless driving. The appeal states the judge should have deferred to the way California lawmakers decided to target reckless driving by paparazzi.

"It was not the trial court's role to substitute its views for those of the Legislature and strike down a valid statute because it felt there were other 'effective' ways to address the problem," the filing states.

Raef still faces traditional reckless driving charges for the July chase involving Bieber on a freeway. That case is temporarily on hold. Raef has not yet entered a plea.

The law used to charge Raef was influenced by the experiences of Jennifer Aniston, who provided details to a lawmaker on being unable to drive away after she was surrounded by paparazzi on Pacific Coast Highway.
